Definitions

Unless otherwise specified, the terms below shall have the following meanings:

'MRC' means Mobility Research Centre Limited.

'This site' means tacpro.com.au.

'You' and 'your' means the customer or user of this site.

'We', 'our' and ,'us' means TacPro by Mobility Research Centre Limited and all related properties.

'the products' means your order.

'the terms and conditions' means all of the requirements set out below.

General Terms

By accessing and using this site you are agreeing that you have read, understand and accept that you are to conform to and be bound by the terms and conditions set out herein. Your use of this site is subject to the terms and conditions and all applicable laws. If you do not agree to these terms and conditions, then you are not allowed to use or browse this site.

We may modify, alter or otherwise update the terms and conditions that are applicable to this site from time to time. It is your responsibility to regularly check the terms and conditions to ensure that you agree with all the requirements that are set out. You agree to the terms and conditions, and accept that you are to be bound by these terms and conditions upon accessing and browsing this site.

These terms and conditions constitute the entire agreement relating to the supply of the Products and the use of this site.  No representation, warranty, terms or conditions shall be binding on us, unless it is included in the terms and conditions or required by law.

These terms will be interpreted and take effect as an agreement made in Australia and will be governed by Australian law, and the parties submit to the non-exclusive jurisdiction of the Australian courts.

We shall be entitled, at any time without prior written notice or any legal responsibility to you, to cancel or suspend any or all of the services provided through or by this site and/or substitute alternative services, which may or may not be suitable for the original purpose.

Registration with TacPro

You are required to register with us when you make an order via this site. When you register with this site you will be asked for some personal information such as your name, delivery address, email address and a password. Your email and password should be kept private as this information can be used to make orders on this site.

We will never ask you for your password. We recommend not relating your password to any readily accessible data such as any personal information (your name, birth-date, address, telephone number, driver’s licence, licence plate or passport). We also recommend that your password doesn’t contain any obvious combinations or sequences or letters or numbers. You are entirely responsible for maintaining the security of your login and password, and for all activity pertaining to your login and password, whether authorised or unauthorised. If any unauthorised party gains access to your login and/or password, please notify us immediately and change your login and password details accordingly. We shall not have any liability for your failure to comply with these obligations.

 

Ordering with TacPro

You may place an order with us by:-

    • Logging onto this site and using your account login and password;

      or

        • Calling us on 1300 TAC PRO (1300 822 776).

          Orders are irreversible and represent an offer by you to purchase the Products at the price, and per the terms displayed on this site.  Payments are required to be made via Shopify Payments (Swipe).  If you do not have an account, there is an option to pay via credit card.  Your account or credit card will be charged at the time of ordering.  You will be notified via email when your order has been accepted and when it is being processed.  

          Even though your order may have been accepted, we may cancel your order by notice in writing to you at any time for any reason which is beyond our reasonable control including, but not limited to industrial action; where the Product cannot be manufactured because of shortage in materials; where the Product has been destroyed or damaged before delivery to you; where there are significant shipping delays or failures by our shipping agents.  If we cancel your order we will immediately refund, by credit to the credit card you used to make the payment for the order, the amount debited to that account; and we shall not be liable to you or any other person for any loss or damages suffered by you due to a failure by us to perform our obligations.

           

          Delivery and Dispatch

          You acknowledge that all Product is shipped to you by our distribution centre in Sydney.We will take reasonable measures to ensure that the Product is delivered as close as possible to the target delivery date (within 4 - 5 business days), and to the address specified on your order. We will endeavour to give you notice of changes in the target delivery date.  All risk and ownership of the Products shall pass to you at the time we try to deliver the Product to you. If you fail to accept delivery for any reason or if we are unable to deliver the Product, risk and ownership of the Product shall nevertheless pass to you at the time we try to make delivery. We shall have no liability to you for any losses arising because of delay in the delivery of the Product, whatever the cause of the delay.

           

          Electronic Messages

          If you enter your email address into this site, then you have agreed to us providing you with unsolicited information about our products and services in electronic form to that email address. You may request that we remove your email from our database at any time.

           

          TacPro Content

          The information on this site is owned by or licenced to us. All material on this site, including without limitation, any text, images, designs, graphics, pictures, videos, software, music and sound files, the layout, the look-and-feel and any other information contained on or in this site (collectively known as the Content for the purposes of this part) is subject to copyright, various intellectual property protections (registered and unregistered) and other exclusive rights.

          You may not copy, replicate, display, publish, upload, convey, store (including in electronic form) or change in whole or part, whether in text, graphic, audio or video any part of the Content without prior written consent from us.

          You may not upload or republish the Content on any internet, intranet or extranet site, or include the information in any other database or compilation, and any other use of the Content is strictly prohibited.

          Trademarks, logos, model names, brands and service marks (collectively known as the Branding for the purposes of this part) displayed on this site are registered or unregistered marks of TacPro® by Mobility Research Centre Limited, or have been licenced to us for use on this site by third parties.

          We are the owner or licencee of the Branding. You may not use any of the Branding without prior written consent from us.

           

          Unauthorised Use or Interference

          You may not:-

          • Attempt to gain unauthorised access to any part of this site, or attempt to acquire any materials, information or documents through any means not purposely made available by us, including without limitation, hacking, password mining or otherwise accessing data without authorisation;
          • Test the vulnerability of this site or any network connected to this site or seek to trace any information through any other use of this site;
          • Upload or use any software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or this site.
          • Use this site in any unlawful manner or in any other manner that could damage, disable, overburden or impair this site;
          • Use automated scripts to collect information from or otherwise interact with this site;
          • Impersonate any person or entity, or falsely state or otherwise misrepresent yourself;
          • Use or transmit the personal information of any third party, including without limitation, names, addresses, phone numbers and email addresses.

This site uses cookies for the sole purpose of recording aggregate information to perform analyses of the characteristics and behaviours of this site’s users and to make improvements to this site.  We use cookies to keep track of users’ preferences and consequently to design this site to best meet the users’ requirements.
